If you are using the App on behalf of an organization, you are agreeing to these Terms for that organization and confirming that you have the authority to bind the organization to these Terms. You also agree to the Privacy Policy, No Refund Policy and Competitive Set Policy.

Occupancy Online is a web-based application designed to collect daily data from registered hotels. The collected data allows hoteliers to generate competitive reports such as Market Penetration Index (MPI), Average Rate Index (ARI), and Revenue Generation Index (RGI).

3. Registration and Account Security:

To use the App, you must register and create an account. You agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and are responsible for all activities under your account. Notify us immediately if you suspect any unauthorized use of your account.

4. Data Collection and Use:

By using the App, you consent to the collection and use of data from your hotel as described in our Privacy Policy. This data may include, but is not limited to, occupancy rates, room prices, and revenue data.
Occupancy Online will use this data to generate reports and analytics. We take reasonable measures to protect the confidentiality and security of your data, but we cannot guarantee its absolute security.

5. User Responsibilities:

You agree to use the App in compliance with all applicable laws and regulations.
You agree not to use the App to upload or distribute any illegal, harmful, or otherwise objectionable content.
You are responsible for ensuring that your use of the App, including the collection and analysis of data, complies with all applicable laws, including data protection laws.

6. Intellectual Property Rights:

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by occupancy online, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Disclaimer of Warranties: The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the App or the information, content, materials, or products included on the App.
Limitation of Liability: To the fullest extent permitted by law, Occupancy Online shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; or (iv) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the App, whether based on warranty, contract, tort, or any other legal theory, whether or not we have been informed of the possibility of such damage.
